1. Account Registration & Eligibility
By creating an account or completing our 5-step onboarding flow, you certify that you are at least 18 years old or have reached the age of majority in your jurisdiction.
- Account Accuracy: You agree to provide accurate, current, and complete information during onboarding and to keep your portfolio credentials secure.
- Portfolio Custody: You are solely responsible for all activities, metrics uploads, and brand communications that occur under your shared portfolio decks. You must immediately notify us of any unauthorized use of your account.
2. UGC & Content Ownership Rights
You retain full ownership of the case studies, videos, images, and text that you upload to UGCDecks. However, to keep our platform operational, you grant us specific rights:
Platform License: You grant UGCDecks a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable license to host, cache, store, and display your uploaded content publicly specifically for the purpose of serving, distributing, and rendering your public portfolio links to brands and web visitors.
Content Integrity: You represent and warrant that you own or have the appropriate usage rights for any brand work, media, or metrics showcased on your deck. You agree not to publish fraudulent metrics or plagiarized content.
Copyright Infringement (DMCA): We respect intellectual property rights. If you believe any content hosted on our platform infringes a copyright, you may submit a formal takedown notice to our designated copyright agent at [email protected].
3. Fees, Billing, & Subscription Cycles
Certain features of UGCDecks may be offered as paid subscription services. By signing up for a premium tier, you agree to our pricing, billing cycles, and payment terms:
- Recurring Billing: Subscriptions automatically renew on a recurring basis (monthly or annually) unless canceled through your billing portal prior to your renewal date.
- No Refunds: All fees are non-refundable unless explicitly stated otherwise or mandated by local consumer protection laws.
- Price Adjustments: We reserve the right to modify our subscription plans or pricing. Any changes will be communicated ahead of time and apply to subsequent billing cycles.
4. Prohibited Conduct
To maintain a high-quality environment for creators and brand partners, you agree not to use UGCDecks to:
- Upload defamatory, obscene, deceptive, or intentionally misleading conversion metrics.
- Insinuate a brand partnership, case study validation, or contract that never legally existed.
- Attempt to reverse-engineer our portfolio platform, layouts, or infrastructure.
- Deploy bots, scrapers, or automated tools to manipulate platform impressions.
5. Termination & Suspension
We reserve the right, without notice and in our sole discretion, to terminate or suspend your account and access to UGCDecks if you violate these terms, engage in fraudulent behavior, or pose a security risk to our infrastructure. Upon termination, your right to use the platform ceases immediately, and we may delete your public portfolios.
6. Limitation of Liability & Disclaimers
UGCDecks provides the tools to build structured, scannable portfolios. However, we do not guarantee brand deals, employment, or conversion spikes resulting from your use of the platform.
The service is provided on an "as-is" and "as-available" basis. UGCDecks disclaims all warranties of any kind, whether express or implied. In no event will UGCDecks, its affiliates, or employees be liable for any indirect, incidental, or consequential damages arising out of your lost brand negotiations, business relationships, or platform downtime, even if advised of the possibility.
7. Governing Law & Dispute Resolution
These Terms of Service and any dispute arising from your use of UGCDecks shall be governed by and construed in accordance with the laws of the Bangladesh, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located within that jurisdiction.
8. Modifications to Service & Terms
We reserve the right to modify, suspend, or discontinue any aspect of our portfolio platform at any time. We also reserve the right to revise these terms. If a revision is material, we will provide notice prior to the new terms taking effect. Continued use after changes means you accept the updated rules.
